 An expanded tax break limited to conservation easement donations expired December 31, 2007, but a new Farm Bill is currently in Congress that seeks to indefinitely expand the more favorable tax incentives allowing donors to use the appraised conservation easement value to:

  • Deduct up to 50% of your adjusted gross income in any year (up from 30%);
  • Deduct up to 100% of your adjusted gross income if the majority of that income came from farming, ranching or forestry; and
  • Continue to take deductions for as long as 15 years (up from 5 years) after the initial deduction.
